Die nachfolgenden Allgemeinen Geschäftsbedingungen (AGB) sind Grundlage der Benutzung aller von der Sciarc GmbH betriebenen Websites.
Mit der Nutzung der von Sciarc angebotenen Websites akzeptieren Sie diese AGB. Bitte lesen Sie diese deshalb sorgfältig und vollständig.

§ 1 Registrierung

Die Nutzung der Bereiche zur zertifizierten ärztlichen, apothekerlichen und VDBD Fortbildung ist Angehörigen der Heilberufe oder des Heilgewerbes sowie Personen vorbehalten, die mit Arzneimitteln, Medizinprodukten, Verfahren, Behandlungen, Gegenständen oder anderen Mitteln legal Handel treiben oder sie in Ausübung ihres Berufes anwenden. Hierzu zählen insbesondere

Ärzte
Medizinstudenten
Apotheker und deren Fachpersonal
Medizinisches Fachpersonal von Praxen und Kliniken
Mitarbeiter der pharmazeutischen Industrie sowie
Fachjournalisten.

Für die Nutzung der Fortbildungs-Bereiche ist eine Registrierung erforderlich. Sie sind verpflichtet, bei der Registrierung wahrheitsgemäße und vollständige Angaben zu machen und etwaige Änderungen Ihrer Registrierungsdaten bei der nächsten Nutzung des Fortbildung-Bereichs mitzuteilen.
Sciarc behält sich vor, Ihre Angaben zu überprüfen und den Zugang zu den Fortbildungs-Bereichen ohne Angaben von Gründen wieder zu sperren – insbesondere, wenn Sie bei der Registrierung falsche Angaben gemacht oder gegen die AGB verstoßen haben. Bewusste Falsch-Angaben bei der Registrierung können darüber hinaus juristisch verfolgt werden.
Nach Absenden des Registrierungsformulars erhalten Sie eine Bestätigungsmail an die Mailadresse, die Sie in das Formular eingetragen haben. Der Zugang zu den Fortbildungs-Bereichen der Sciarc-Website ist nur mit Ihrem individuellen Passwort möglich. Sie dürfen dieses Passwort nicht an Dritte weitergeben. Wird Ihnen eine missbräuchliche Verwendung Ihres Passwortes bekannt, sind Sie verpflichtet, Sciarc davon unverzüglich in Kenntnis zu setzen.
Jeder Teilnehmer kann seine Registrierung jederzeit rückgängig machen. Die Rücknahme ist per E-Mail an die Adresse info@sciarc.de mitzuteilen. Sofern ein Teilnehmer seine Registrierung zurücknimmt, werden dessen Registrierungsdaten und alle damit verbundenen Dateneinträge innerhalb von einem Monat nach Eingang der Rücknahme gelöscht.

DocCheck

Neben einer direkten Registrierung auf den Sciarc-Websites können Sie eine Anmeldung über einen bestehenden DocCheck-Account vornehmen. Wir weisen Sie darauf hin, dass DocCheck sog. Cookies verwendet - das sind Textdateien, die im Browser des Nutzers gespeichert werden -, um die Nutzung der Dienste zu erleichtern. Die durch diese Cookies erzeugten Informationen werden lediglich an Server von DocCheck übertragen und weder mit dem Webseitenbetreiber, noch sonstigen Dritten geteilt. Eine Datenübertragung in Länder außerhalb der EU findet nicht statt.

Im Rahmen der Nutzung des DocCheck Passwortschutzes erhebt DocCheck, ausgehend von der Website des Informationsanbieters, welcher den Login per "embed" bzw. iFrame in die Website einbindet, die sog. Protokolldaten (IP-Adresse, Zugriffsdatum, Zugriffszeit, Referrer-URL, Informationen über genutzte Hard- und Software wie z.B. Browsermerkmale, Geräteinformationen wie z.B. die Auflösung) des Nutzers. Diese Daten werden nicht genutzt, um Rückschlüsse auf die Person zu ziehen, sondern dienen dazu, die richtige Darstellung der Seiten- oder iFrame-Inhalte und/oder die Sicherheit der DocCheck-Dienste zu gewährleisten.

Newsletter

Der Versand eines Newsletters und die mit ihm verbundene Erfolgsmessung erfolgt auf Grundlage einer Einwilligung der Empfänger gem. Art. 6 Abs. 1 lit. a, Art. 7 DSGVO i.V.m § 7 Abs. 2 Nr. 3 UWG bzw. auf Grundlage der gesetzlichen Erlaubnis gem. § 7 Abs. 3 UWG. Die Protokollierung des Anmeldeverfahrens erfolgt auf Grundlage unserer berechtigten Interessen gem. Art. 6 Abs. 1 lit. f DSGVO. Unser Interesse richtet sich auf den Einsatz eines nutzerfreundlichen sowie sicheren Newsletter-Systems, das sowohl unseren geschäftlichen Interessen dient, als auch den Erwartungen der Nutzer entspricht und uns ferner den Nachweis von Einwilligungen erlaubt.

§ 2 Datenschutz

Sciarc verpflichtet sich, die bei der Registrierung und bei der Nutzung der Fortbildungs-Bereiche erhobenen, verarbeiteten und gespeicherten Daten vertraulich und nach den Bestimmungen der Datenschutz-Grundverordnung (DSGVO) zu behandeln. Bei Fragen wenden Sie sich gerne an info[at]sciarc.de.

Nach Maßgabe des Art. 13 DSGVO informieren wir Sie über die Rechtsgrundlagen unserer Datenverarbeitungen. Sofern die Rechtsgrundlage in der Datenschutzerklärung nicht genannt wird, gilt Folgendes: Die Rechtsgrundlage für die Einholung von Einwilligungen ist Art. 6 Abs. 1 lit. a und Art. 7 DSGVO, die Rechtsgrundlage für die Verarbeitung zur Erfüllung unserer Leistungen und Durchführung vertraglicher Maßnahmen sowie Beantwortung von Anfragen ist Art. 6 Abs. 1 lit. b DSGVO, die Rechtsgrundlage für die Verarbeitung zur Erfüllung unserer rechtlichen Verpflichtungen ist Art. 6 Abs. 1 lit. c DSGVO, und die Rechtsgrundlage für die Verarbeitung zur Wahrung unserer berechtigten Interessen ist Art. 6 Abs. 1 lit. f DSGVO. Für den Fall, dass lebenswichtige Interessen der betroffenen Person oder einer anderen natürlichen Person eine Verarbeitung personenbezogener Daten erforderlich machen, dient Art. 6 Abs. 1 lit. d DSGVO als Rechtsgrundlage. Weitergabe von Daten Sofern wir Daten im Rahmen unserer Verarbeitung gegenüber anderen Personen und Unternehmen („Auftragsverarbeitern“ oder „Dritten“) offenbaren, sie an diese übermitteln oder ihnen sonst Zugriff auf die Daten gewähren, erfolgt dies nur auf Grundlage einer gesetzlichen Erlaubnis (z.B. wenn eine Übermittlung der Daten an Dritte, wie an Zahlungsdienstleister, gem. Art. 6 Abs. 1 lit. b DSGVO zur Vertragserfüllung erforderlich ist), Sie eingewilligt haben, eine rechtliche Verpflichtung dies vorsieht oder auf Grundlage unserer berechtigten Interessen (z.B. beim Einsatz von Beauftragten, Webhostern, etc.). Sofern wir Dritte mit der Verarbeitung von Daten auf Grundlage eines sog. „Auftragsverarbeitungsvertrages“ beauftragen, geschieht dies auf Grundlage des Art. 28 DSGVO.

Widerruf

Sie haben das Recht, erteilte Einwilligungen gem. Art. 7 Abs. 3 DSGVO mit Wirkung für die Zukunft zu widerrufen. Sie können der künftigen Verarbeitung der Sie betreffenden Daten nach Maßgabe des Art. 21 DSGVO jederzeit widersprechen. Der Widerspruch kann insbesondere gegen die Verarbeitung für Zwecke der Direktwerbung erfolgen.

Google Analytics

The following General Terms and Conditions (GTC) are the basis for the use of all websites operated by Sciarc GmbH. By using the websites offered by Sciarc you accept these terms and conditions. Please read them carefully and completely.

§ 1 Registration

The use of certified medical, pharmacy and VDBD training areas is reserved for healthcare professionals or the healthcare industry, as well as individuals who legally trade in or use medicines, medical devices, procedures, treatments, supplies or other means in the exercise of their profession. These include in particular

Medical students
Pharmacists and their specialist staff
Medical staff of practices and clinics
Employees of the pharmaceutical industry as well
Journalists.

For the use of the training areas, a registration is required. You are required to provide truthful and complete information when registering, and to communicate any changes to your registration data the next time you use the Training section.

Sciarc reserves the right to check your details and to block access to the training areas without stating any reasons - in particular if you have given incorrect information or violated the terms and conditions at registration. Conscious false information during registration can also be legally prosecuted.

After submitting the registration form, you will receive a confirmation e-mail to the e-mail address you entered in the form. Access to the training areas of the Sciarc website is only possible with your individual password. You may not share this password with third parties. If you become aware of any misuse of your password, you must notify Sciarc immediately.

Each participant can cancel his/her registration at any time. The redemption must be communicated by e-mail to the address info@sciarc.de. If a participant withdraws their registration, their registration data and all associated data entries will be deleted within one month of receipt of the withdrawal.

DocCheck

In addition to direct registration on the Sciarc websites, you can register via an existing DocCheck account. We point out that DocCheck uses so-called cookies - these are text files that are stored in the user's browser - to facilitate the use of the services. The information generated by these cookies will only be transmitted to DocCheck servers and will not be shared with the website operator or other third parties.
